The Supreme Administrative Court (STA) upheld the cancellation of the game against Vitória de Guimarães behind closed doors because the video surveillance recordings of the match against FC Porto in February 2020 were not audible and were marked by racist insults. Malian footballer Moussa Marega, then employed by the Blue and White.
According to a judgment of 7 April, repeated by Lusa, STA did not accept the Portuguese Football Association’s (FPF) review appeal, arguing that “the bodies decided in essentially the same direction and the judgment under appeal appears to be well founded in a credible manner on the issues raised by the applicant”.
In addition to revoking the penalty for playing behind closed doors, Vitória was also released from paying a fine of five thousand euros.
The FPF’s Disciplinary Board (CD) had convicted Vitória de Guimarães of the SAD on 17 May 2021 for: a fine of five thousand euros and a penalty for playing behind closed doorsAfter a meeting with FC Porto. The question of what would be the fourth penalty game was that the Minho club had not provided the sound of the recordings recorded by the video surveillance system of D. Afonso Henriques Stadium in a game that Dragons won by two. -1 and marked by racist insults against Marega.
Vitória then appealed to the Sports Arbitration Court, which upheld the Minho people and upheld the application for annulment of the contested decision. FPF subsequently appealed against this decision to the Central Administrative Court (TCA) do Sul, which dismissed the appeal on the grounds that Vitória could not be penalized for the lack of sound from the recordings because the video surveillance system installed in the stadium did not offer sound recording on all cameras.
“It is assumed that the system would be more efficient with simultaneous collection of sound and image, but it was not what was designed, approved and installed, because there will be only one collection of sound per zone, not per camera and in each zone.”
Vitória has already met The first penalty for three games behind closed doors, On the racist insults against Marega by the FPF CD on 4 May 2021, when all sites were closed to the public due to the covid-19 pandemic. He did it against Famalicão and Benfica in the games of the 2020/21 season and against Leixões in the first round of the 2021/22 league cup.
